Plaintiff contended this to be defamatory speech and filed a lawsuit. We found this as an abusive action to silence our client, and filed an <a href=\"https:\/\/www.clfip.com\/ip\/blog\/ufaqs\/what-is-anti-slapp-motion\/\">anti-SLAPP<\/a> motion.\u201d<\/p>\n<p>\u201cThe court agreed with us that plaintiff was at the very least a limited public figure and had failed to establish a showing of actual malice. Regardless, the court also determined that our client\u2019s statements were opinion,\u201d Chhabra continues.<\/p>\n<p>The court explained \u201c&#8230; defendant\u2019s assertions are matters of opinion, not fact. Plaintiff seems to regard it as obvious that \u2018conspiracy theory\u2019 is an accusation of fact, not opinion. &#8230; In today\u2019s political sphere and public discourse, labeling one\u2019s opponent\u2019s views as a \u2018conspiracy theory\u2019 is a pejorative characterization of the opponent\u2019s views \u2013 much like labeling one\u2019s opponent as fascist, communist, racist, hypocritical, pro-crime, anti-farmer, moronic, irrational, and so on and so on. Plaintiff posits no understanding of the term \u2018conspiracy theory\u2019 that is susceptible to factual proof or disproof.\u201d<\/p>\n<p>\u201cThe court provided a very thoughtful analysis, meticulously dissecting each issue. Advocates of free speech should rejoice this decision,\u201d concludes Chhabra.<\/p>\n<p>The case is Tully v. Chouinard, CIV-MSC20-01019 (Contra Costa Sup.
